Pro Bono Attorney Seeking Expert to Analyze Impact Study Provided By D.C. City Planners For Massive Upzoning Proposal to Determine if Study Complies With Past Practices and Current Regulations

Matter Location:  Washington, D.C.

Matter: A pro bono attorney is representing local community members in a case in DC Superior Court titled Belt v. District of Columbia, Case No. 2021 CA 001651 B.  This case is important for advancing community-centered equitable development in DC.  Plaintiffs allege that DC Council’s enactment of the 2021 Comprehensive Plan amendments violated DC law, regulations, and past practice because the Office of Planning and the Council failed to evaluate and prove the efficacy of the amended provisions before enacting them as the law requires.

Plaintiffs seek an expert who is able to review the impact study and any planning analyses provided by D.C. city planners before passage of the Comprehensive Plan amendments to determine whether such study and analyses complied with the requirements of DC law, regulations, and past practice before Council approved nearly 200 million square foot of proposed upzoning.  The expert would need to compare and contrast the current impact study with a studies and analyses provided in 2006 and 2011.
